So because of this a large increase of complaints to the <a href="http://www.ftc.gov/bcp/consumer.shtm">Federal Trade Commission (FTC), </a> <a href="http://www.ag.ca.gov/">Attorney General (AG)</a> and the Department of <a href="http://www.dre.ca.gov/mlb_adv_fees.html">Real Estate (DRE)</a> have also taken place. Resulting in many of these scam companies being sued and subsequently shut down.<br />

Homeowners who are behind on their payments will often get contacted by a company who claims they offer special loan modification services. Beware of this, if your home is in the foreclosure stage it is posted in public records (like the newspaper) and that is probably how these companies found you.<br />
<span id="more-428"></span> <br />
Many of those companies offering loan modification services claim to have “inside knowledge” of the mortgage industry and promise that they will “cut through the red tape” to convince your mortgage servicer to change the terms of a loan. More than likely these are just brokers who will try to collect an upfront fee and run with your money.</p>
<p>What most consumers don’t know is that section 2945 of the California Civil Code requires “foreclosure consultants”, that is, people who do loan modifications, to be A. Attorneys or B. registered with the Department of Real Estate before an advance fees can be accepted. Section 2945 also states that even if registered, a loan modification company cannot accept advance fees after a Notice of Default has been served.</p>
<p>Even the Federal Trade Commission is cracking down on fraud and deception by mortgage modification and home foreclosure rescue companies. The FTC is seeking to halt the proliferation of these mortgage relief scams – which target distressed and vulnerable consumers who are delinquent or facing foreclosure – through increased law enforcement, consumer outreach, and close coordination with federal, state, and non-profit partners.</p>

<p>The bill, SB 94, authored by Sen. HARRISBURG, Pa., April 22 /PRNewswire-USNewswire/ &#8212; The Department of Banking recently ordered four out-of-state <a href="http://www.modifyloan.net">mortgage modification</a>  companies to stop engaging in unlicensed activity in Pennsylvania.<br />
The department issued cease and desist orders against Consumer Loan Modification of Arizona and U.S. Settlement Services of Florida on April 10 and Federal Loan Modification Law Center LLC of California on April 14. All three companies advertise on their Web sites to refinance mortgage loans in Pennsylvania when they are not licensed to do so. The companies must comply with the orders or file appeals by the end of April. <span id="more-301"></span><br />
The department also entered into a consent agreement and order with Nationwide Foreclosure Prevention Center, LLC of New Jersey and its owner, Robert P. Valentin, to stop doing business in Pennsylvania. The company was fined $2,000. Valentin is prohibited from engaging in the mortgage business in Pennsylvania for five years and must refund fees that he collected from Pennsylvania consumers within 90 days. The department also cited Valentin for unlicensed activity in 2008 under the name Justice Mortgage.<br />
The Department of Banking reminds homeowners that they can receive free help from a certified housing counseling agency by contacting the Pennsylvania Housing Finance Agency at 1-800-822-1174 or <a href="http://www.phfa.org">www.phfa.org</a>. Homeowners can also speak directly with their loan servicer to discuss options to avoid foreclosure.<br />

<p>SACRAMENTO, Calif.&#8211;(Business Wire)&#8211; After a joint investigation, the California Departments of Corporations (DOC) and Real Estate (DRE) issued separate Desist and Refrain Orders against 2nd Chance Negotiations, Inc., ordering the company to stop performing loan<br />
modification services.</p>
<p>&#8220;While the current market has created some wonderful opportunities for those looking to buy, it has also fostered an environment ripe for abuse,&#8221; DRE Commissioner Jeff Davi said. &#8220;With so many folks struggling to stay in their homes, foreclosure rescue scams have risen dramatically. The department is aggressively pursuing individuals and companies trying to cash in on Californians in their time of need.&#8221; <span id="more-257"></span></p>
<p>2nd Chance Negotiations, Inc., based in Fair Oaks, California, solicited financially stressed borrowers, and, in exchange for an upfront fee, promised borrowers they would negotiate with the borrower`s lender to modify the terms of the borrower`s loan. However, the joint investigation established that 2nd Chance Negotiations, Inc. was not licensed and/or legally authorized to perform the promised services or collect advance fees. 2nd Chance Negotiations, Inc. can request an administrative hearing to challenge the orders.</p>
<p>&#8220;The State has worked hard through various means to help distressed homeowners avoid foreclosure,&#8221; stated DOC Commissioner Preston DuFauchard. &#8220;We will take swift action against unscrupulous operators who violate State laws.&#8221;</p>
<p>Loan modification scams are worrisome and widespread. Last July, the DRE had fewer than 10 complaints involving loan modification companies. Today the department has 500 pending investigations. In addition, since last October the DRE has filed over 60 Desist and Refrain Orders and/or Accusations involving <a href="http://www.modiflyloan.net">loan modification</a> scams.</p>
<p>The DRE Web site has important consumer information on how consumers can protect themselves against unscrupulous providers who collect advance fees promising financially stressed borrowers relief, but instead, do nothing. The Commissioner encourages all consumers to log on to DRE`s Web site at http://www.dre.ca.gov/mlb_adv_fees.html, and to check out brokers wanting an up-front fee in exchange for loan modification help.</p>
<p>&#8220;It is important to keep in mind that no person is required to pay a third party for a loan modification,&#8221; Commissioner Davi stated. &#8220;A consumer can simply call his or her lender or use the services of a nonprofit housing counselor.&#8221;</p>
<p>In general, and with limited exceptions, only licensed real estate brokers and California attorneys operating as lawyers within the scope of their license, may collect advance fees. Real estate brokers must have their advance fee agreement reviewed and sanctioned by the DRE prior to its use. Information on DRE`s web site will help consumers ensure that a company wanting an advance fee is properly licensed and can legally collect an advance fee before they sign on the dotted line.</p>

<p>That said, we need to make sure we are paid, and we do not want to be just one more creditor of the many seeking to collect from our clients. We ask for full payment up front.</p>
<p><strong>As to guarantees.</strong></p>
<p>Lawyers do not guaranty the outcomes of their cases or matters. We are lawyers and zealously represent our clients. That is how we earn our fee… through the actual work we do. <span id="more-99"></span></p>
<p>If a <a href="http://www.modifyloan.net">loan modification</a> does not work out (it happens), that is when we are of even more value to our clients. <p>Well said Paul,Im in a fix myself,and Ive been a REALTOR for 17yrs.There are a lot of angels,on the loan mods,some want money up front,? and there is no guarantee a loan mod will be approved even with a rep co.and you’ve loss 2 months to find out a no</p>

<p>Well, the BBB seems to be giving all loan mod companies lower than expected ratings due to the fact that the field is getting filled with corrupt businesses. The legitimate companies are being spoiled by being in a bunch of rotten apples. That said, it is one of the sources you should examine, but not the only source.</p>

<p>No way around it, many potential clients who call my office want to hear that we guarantee their loan modification. They have read promises of balance reductions and super low fixed rates on the websites sites of loan modification companies, heard the radio commercials, and opened their junk mail (both email and U.S. Mail).</p>
<p>We know what people have heard. But when one thinks it through, a guarantee is just plain ridiculous. Each loan modification is unique. Some of the factors at play are the borrower’s ability to pay, the hardship, the location of the property, the amount of equity to loan balance, the lender’s financial situation, the attitude of the negotiator at the lender, the timing (whether the month was bad for real estate sales or really bad for real estate sales).</p>
<p>So many things affect the outcome. One of the hardest parts of advising people on loan modifications is making sure that a person really wants to stay in their home. Sometimes, the home is just unaffordable, no matter how low the rate.</p>
<p>When someone makes $3k a month and they bought a $700k home with no money down, it might be time to face the facts. Letting the house go through short sale or otherwise and then renting might really be the best choice. This is a discussion I have with my clients, and I make sure they get an education on all their options. The decision is left to the client, but I make sure it is an informed decision.</p>

<p>My neighbor had a guy call him about a <a href="http://www.modifyloan.net">loan modification</a> and said he was a lawyer. He said it would cost 3,000 dollars for his fee and he would take the cost of his house from 310,000 to 233,000 and bring his interest rate from 6.5 to 5, plus 3 months off from paying his mortgage. Now this sounds too good to be true.</p>
<p>Is there anyway this could be for real?</p>

<p>Well, I guess it could possibly under some special set of circumstances if the stars and planets are all in alignment… be true… but… how the heck would someone know exactly what interest rate and exactly what balance a person would get. Any such claims should be examined for misleading statements very carefully and then? Examined again.</p>

<p>2. Is there a statute of limitation when suing my lender for predatory lending? That is, if it has been more than three years since the loan closed, do I still have a case?</p>

<p>In general, California law prohibits a non-licensed attorney or a non-DRE approved company from taking money up front to handle a loan modification IF THE BORROWER IS IN DEFAULT. Violating California law on this matter might result in the illegal act-doer being hit with THREE times the charge for the service as a penalty. As to statutes of limitations, each statute sets its own limit and the same holds true for non-statutory laws.</p>
